But now the coroner investigating the victims’ deaths plans to examine his crucial defence claim of “cognitive impairment” at the controls.
Legal papers show East Sussex Coroner Penelope Schofield has demanded access to Hill’s cockpit GoPro footage, expert medical reports and criminal court transcripts.
The material is “protected” under EU law, meaning it can only be used for safety investigations. But Ms Schofield’s battle for the papers will be settled in the rare secret hearing, likely to be in December.
A High Court judge likened it to a closed “public interest immunity” court session — normally used by MI5 or MI6.
Ms Schofield also wants to probe the findings by two Air Accidents Investigation Branch (AAIB) reports on grounds of “potential incompleteness”.
High Court documents show she will assess if Hill’s “conscious and deliberate conduct contributed to the crash”.Most read in The US SunSHOCK CLAIM TV host John Walsh reveals where he believes Brian Laundrie is currently hidingExclusive'OFF GRID GUY' Gabby Petito's fiancé has resources to get out of US illegally, friend saysSHORT SHRIFT Hooters waitresses cry f-owl over new uniform with skimpy 'X-rated' shortsMAN ALIVE Penis ring is first ever wearable "erection tracker" that detects disease riskBY HIS SIDE Hillary Clinton spotted leaving hospital after Bill in ICU with ‘sepsis’HOWIE'S HORROR Howie Mandel son gives update on dad's health as he 'lies lifeless on floor'
The inquest will also challenge whether he “suffered a cognitive impairment which affected his flying abilities”.
If she finds Hill at fault, it could pave the way for civil lawsuits from victims’ families.

Schiff: January 6 committee decision on criminal contempt charges for Mark Meadows could come this week
(CNN)The House select committee investigating the January 6 insurrection will make a decision "this week" on whether it will refer Mark Meadows for criminal contempt charges for defying a subpoena before the Thanksgiving recess, California Rep. Adam Schiff, a member of the panel, said Sunday."I think we will probably make a decision this week on our course of conduct with that particular witness and maybe others," Schiff told CNN's Dana Bash on "State of the Union." "I can't go into ... what communications that we're having or haven't had with particular witnesses, but we are moving with alacrity with anyone who obstructs the committee, and that was certainly the case with Mr. Bannon. It will be the case with Mr. Meadows, and Mr. Clark or any others."The looming decision by the committee comes amid attempts to try to get Meadows -- the former White House chief of staff for former President Donald Trump, who defied his subpoena from the panel -- to comply with the panel's request as it seeks more information about the events at the US Capitol on January 6.
